Additionally, the State Environmental Inspection of Ukraine appeals to consumers, as well as executive authorities, executive bodies of local councils, law enforcement agencies, consumer public organizations, and associations of economic entities, requesting them to report any information regarding the distribution of products that pose harm to public interests, have deficiencies that may cause such harm, and lack information that would allow the identification of the manufacturer of such products, but contain information that could identify the distributor from whom such products were purchased (discovered).

We remind you that the responsibility of economic entities is stipulated in Article 44 of the Law of Ukraine "On State Market Surveillance and Control of Non-Food Products," which provides for the application of administrative and economic sanctions.

Thus, a person who introduces products into circulation that pose a serious risk will face a fine of six thousand non-taxable minimum incomes of citizens (102,000.00 UAH).

A person who introduces products into circulation that do not meet established requirements (except in cases provided for in Article 28 and part three of Article 29 of this Law) will be fined between two to three thousand non-taxable minimum incomes of citizens (34,000.00 UAH - 51,000.00 UAH).

For distributors (except legal entities and individual entrepreneurs who have chosen a simplified taxation system), in case of non-compliance with the storage conditions of the products they distribute, if as a result the products became dangerous and/or do not meet established requirements, the fine is two thousand non-taxable minimum incomes of citizens (34,000.00 UAH).

For distributors who are legal entities or individual entrepreneurs who have chosen a simplified taxation system, administrative and economic sanctions in the form of a fine will be applied in case of non-compliance with the storage conditions of the products they distribute, if as a result the products became dangerous and/or do not meet established requirements, amounting to one thousand non-taxable minimum incomes of citizens (17,000.00 UAH).

Responsibility is also provided for creating obstacles by preventing inspections, which incurs a fine of 170,000 UAH.

Furthermore, based on the results of state market supervision, a decision will be made to take restrictive (corrective) measures: if the products pose a serious risk or simultaneously pose a serious risk and do not meet established requirements - a decision to withdraw from circulation and/or recall, and prohibit the offering of products in the market; in case of formal non-compliance (the conformity mark is applied in violation of requirements or is absent; a conformity certificate was not issued or the conformity certificate does not accompany the products, etc.) - a decision to eliminate formal non-compliance; if the products do not meet established requirements – a decision to bring them into compliance.
